Bicycle Injury Lawyers

English Spanish

Bicyclists have the same rights and responsibilities as motorists on California’s roads. As much as state laws try to level the playing field, however, bicycles by their nature have unique characteristics that render cyclists more prone to injury than motorists. Indeed, when a rider is injured, there is a greater likelihood that the injuries will be serious. It is important for anyone who has been injured in a bicycle accident caused by another to seek legal representation. Nadrich & Cohen has a proven track record of success with injured clients.

Bicycles are far less expensive to operate and maintain than cars or even motorcycles. However, they are also more dangerous. The National Highway Traffic Safety Administration (NHTSA) reports that 14% of all fatalities on the road involve a bicyclist. Each year over 50,000 riders are injured in accidents. Perhaps even more disturbing is that California leads the nation in the number of deaths in collisions with other vehicles. In the period from 2010-2012 338 cyclists were killed on our state’s roads.

Common Causes of Bicycle Accidents
Riders are inherently more vulnerable to injury accidents due to the design of the bicycle. A cyclist rides with other traffic but has virtually no protection should a collision occur. A 20 pound bicycle is certainly no match for a car that weighs over a ton, not to mention a big rig. Among the more common ways in which injury accidents occur are:
  • A car cuts off the bicycle as it makes a turn.
  • The bicycle has defective parts, or has been improperly maintained/repaired.
  • A vehicle moves into the lane occupied by the bicycle.
  • A parking motorist opens his door into the path of a cyclist.
  • A car backs out of a driveway into the path of the bicycle.
  • A driver fails to yield to a bicycle.
  • The motorist fails to see the bicycle.
  • The road is poorly maintained, e.g. it contains potholes.
  • The bicycle runs into debris in the roadway.
Driving Defensively

Given the dangers inherent to operating a bicycle it is very important that cyclists operate their bikes defensively. Assume that motorists don’t see you. It is also important that you wear safety equipment, especially a helmet. It is also a good idea to use bike lanes when possible. Murrieta currently has about 97 miles of bike lanes in the city, as well as approximately 22 miles of trails.

If you are injured in a bicycle accident, make sure to obtain important information, including the name, phone number, and insurance information of the person who hit you and the names and contact information of any witnesses. If you are able, take pictures of the area with your smart phone. Most importantly, make sure to obtain medical treatment. You should see a doctor even if you don’t think you have been injured. If you are injured due to another’s negligence, make sure that you speak with a personal injury attorney. Call Nadrich & Cohen, LLP today.
