How We Investigate Significant Injury Bicycle Accident Cases
Below is a synopsis of what we do in a significant litigated bicycle injury accident case.
Of course, we investigate for driver error and any design negligence. For design negligence our purpose is to find out if there are any responsible entities such as a city, county or town that may have contributed to the accident through their negligence where otherwise they could have made safety improvements which would have prevented the injury.
We evaluate all collision reports.
If relevant, we will photograph and evaluate all safety and operational aspects regarding uncontrolled, signalized and / or mid-block collision locations. We are often involved in multi-lane commercial street bicycle cases.
If appropriate, we will acquire and evaluate engineering reports for design standards, transportation policies, safety report studies, driver handbooks, guides and plan reports of organizations such as the American Association of State Highway and Transportation officials, the Federal Highway Administration, California Department of Transportation, (CalTrans,) any master bicycle street project and any other relevant state or local engineering or transportation department.
We will obtain all community plans and policy documents and evaluate records or synopsis that involve traffic safety committees, planning commissions, etc. We will acquire and evaluate all records relating to traffic safety enforcement activities at the accident location.
We will interview and, if necessary, hire our own traffic engineers and study each design element if appropriate. Since our teams have already done many cases we have a library of photos and publications throughout California related to bicycle safety and street design.
