How We Handle A Bicycle Roadway Design Case

Roadway Design is an area of the law that proves that negligent roadway design or negligent maintenance contributed to or was the sole cause of our clients’ injuries. In order to pursue a roadway design case, we determine whether or not the roadway contributed to or was the sole cause of the accident or death. Issues that we look at are similar collisions or accidents under similar circumstances, and/or the highway authorities’ failure to respond to prior similar conditions. We will look at the negligent design of the bicycle lane or any dangerous conditions within the bicycle lane. We will analyze the issues surrounding design errors such as dangerously limited sight distances and the appropriate standards for entering sight distance. Oftentimes, construction zone hazards occur in a bicycle case, so we will review that, as well as the traffic control plan.

In order to create a highway design case, we hire a transportation engineer who will determine whether or not the roadway was in compliance with engineering standards and practices. These people are responsible for planning, designing streets and highways. They use numerous source materials.

We will further obtain additional resources from the local bicycle transportation plans (e.g. Seattle/ San Francisco/ Los Angeles bicycle master plan), documents from the Federal Highway Administration, city or state maps of designated bicycle routes, etc.

We have repeatedly successfully recovered on behalf of bicyclists based on roadway design failure.

We prove that a cyclist is owed the same duty as an automobile, and that as a vehicle the state, city, or county has a duty to exercise ordinary care to keep its highways reasonably safe as well as maintaining its streets and roads for the traveling public and maintain proper warning signs for an inherently dangerous or deceptive roadway condition.

That is how we prove successfully a roadway design case for our bicycle clients.

We have succeeded based on the above formula on numerous occasions.
